Hugo Grotius ve John Locke'da Doğal Hukuk Öğretisi

Abstract

Bu çalışmanın gayesi, Avrupa hukuk felsefesi açısından iki kurucu figürun doğal hukuk görüşlerini tasvire çabalamak ve yer yer eleştirilerimizi sunmaktır. Çalışmamızda literatürdeki bâzı farklılıklar karşılaştırıldı. Yer yer önerilerde bulunuldu. Birinci bölümde doğal hukukun etimolojik kökenini tartıştık ve târihçesini ana hatlarıyla sunmaya çalıştık. İkinci bölüm, Hugo Grotius’un düşüncelerine ayrıldı. Üçüncü bölüm ise John Locke’un doğal hukuk görüşünü özetledi. Sonuç bölümü iki düşünürün görüşlerinin değerlendirme ve eleştirisini içeriyor.

The aim of this study is to try to describe the natural law views of the two founding figures in terms of the philosophy of European law and to present our criticisms from time to time. In our study, some differences in the literature were compared. Suggestions were made from place to place. İn the first chapter, we discussed the etymological origins of natural law and tried to outline its history. Second chapter is devoted to the thoughts of Hugo Grotius. Third chapter summarizes John Locke's view of natural law. The concluding section contains the evaluation and criticism of the views of the two thinkers.
