Bu tezde mesafeli satış sözleşmesinde riskin geçişi ve masraf paylaşımı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği ile Türk Borçlar Kanunu çerçevesinde kıyaslanarak karşılaştırmalı bir yaklaşımla ele alınmıştır.
Çalışmamızın konusu kanuni düzenlemelerde kanun koyucunun iradesi doğrultusunda hasar kavramıyla ifade edilse de bu kavramın, konunun özünü yansıtmaktan uzak olması sebebiyle çalışmamızda hasar kavramı yerine risk kavramı kullanılmıştır.
Mesafeli satış sözleşmelerinde riskin geçişiyle birlikte tüketici, satışa konu malı hiç ya da sözleşmede öngörüldüğü biçimde elde edemese bile satıcı, satışa konu malın bedelini tüketiciden talep edebilir ve dolayısıyla tüketicinin bedel ödeme yükümlülüğü devam eder. Masraf paylaşımında genel olarak devir masrafları satıcının, devralmaya yönelik masraflar ise tüketicinin üzerindedir. In this thesis, the passing of risk and the sharing of cost in the distance sales contract are discussed in a comparative approach by being compared within the framework of the Consumer Protection Law and the Distance Contracts Regulation and the Turkish Code of Obligations.
Although the subject of our study is expressed in legal regulations with the term “damage” in accordance with the will of the law guardian, the term “risk” is used instead of the term “damage” in our study since this term is far from reflecting the essence of the subject.
With the passing of risk in distant sales contracts, the consumer, although the seller does not obtain the goods subject to the sale at all or as provided in the contract, the seller can demand the charge of the goods subject to the sale from the consumer and therefore the obligation of the consumer to pay the charge continues. In the sharing of cost, the transfer costs are generally on the seller and the acquisition oriented costs are on the consumer.
