Çocuğun Desteğinden Yoksun Kalan Ana ve Baba Açısından Bakım İhtiyacı İçine Düşme Şartı

Abstract

Ana ve babanın çocuklarının ölümü halinde destekten yoksun kalma tazminat talebinde bulunabilmeleri için bakım ihtiyacı içine düşmeleri gerekmektedir. Ancak, desteğin ölümü sırasında durumları iyi olmakla birlikte, ileride bakım ihtiyacı içerisine düşebilecek ana baba da destekten yoksun kalma tazminatı talep edebilir. Ayrıca, ahlaki bir yükümlülük sebebiyle yapılacak destekten yoksun kalınması da destekten yoksun kalma tazminatını haklı gösterebilir.

In order to be able to claim compensation for loss of support of their child, upon his/her death, the parents must be in need for care. However, the parents can claim compensation for loss of support of their child as well, although they do well at the time of death of their support, provided that it occurs that the parents will be in need for care in the future. In addition to that, a moral obligation to support one's family can justify compensation for loss of support as well.
