İbnu Emîr Hâcc 'in Et-Takrîr Ve't-Tahbîr Adlı Eserinden İctihad ve Buna Bağlı Taklid ve İfta Bölümünün Tahkiki

Abstract

Araştırmamız; giriş, üç bölüm ve sonuç kısmından meydana gelmektedir. Giriş ve birinci bölümde geniş bir biçimde fıkıh usûlünün tarifi yapılıp bu alanda yazılmış önemli eserler ve ekoller hakkında bilgi verildikten sonra Şârih İbn Emîru Hâc ve Müellif İbnü’l-Hümâm’ın biyografisi ele alınacaktır. İkinci bölümde asıl metin ve asıl metnin şerhi tanıtılıp tahkik ve araştırma metodu açıklanacak, üçüncü bölümde ise et-Tâkrîr ve't-Tahbîr’in “ictihad”, buna bağlı olarak da “taklid” ve “iftâ” bölümünün tahkiki yapılacaktır.

This study comprises an introduction, three sections, and a conclusion. The introduction presents the discipline of jurisprudence (uṣūl al-fiqh), its foundations, its various schools, and the most important texts authored in the subject. The first section is an analytical study, comprising a biography of the commentator, Ibn Amīr Ḥājj; a biography of the author of the ground text, al-Kamāl Ibn al-Humām; and an overview of the work, al-Taqrīr wa-al-taḥbīr. The second section elucidates the method deployed in the critical edition and its apparatus, as well as a description of the manuscripts used. Section three presents a critical edition of the third treatise in the book, on the nature of legal-opinion making (ijtihād) and its corollaries of following expert opinions (taqlīd) and the issuing of legal verdicts (iftā’).
