Bilgisizce Fetvâ Verilmesi ile İlgili Hadislerin Değerlendirilmesi

Abstract

İslâm toplumunun geleceğini inşâ etmek için günümüzde en çok ihtiyaç duyulan konuların başında dini bilgilerin insanlara doğru bir şekilde aktarılması gelmektedir. Bu çalışmada fetvâ vermenin sorumluluğu ve ehil olmadan fetvâ vermeye kalkmanın vebâlinin büyüklüğü açıklanmaktadır. Konunun öneminin vurgulanması için Kur’ân’dan sonra İslâm’ın ikinci kaynağı olan Hz. Peygamber’in (s.a.v) hadisleri ve sahâbe sözleri ile fetvâ uygulamaları değerlendirilmektedir. Tezin birinci bölümünde Fetvâ ve Kavramsal Çerçevesi, ikinci bölümünde Tarihte ve Günümüzde Fetvâ, üçüncü bölümünde ise Bilgisizce Fetvâ Verilmesi İle İlgili Hadisler incelenmektedir.

For building the future of the Islamic community, one of the most needed issue today is to convey religious knowledge to the people properly. In this study, how much responsibility it takes to issue a fatwa and how big sin is to issue a fatwa without being competent are reminded. For a better understanding of the importance of the subject, the hadiths of Prophet Muhammad (peace be upon him) which is the second source of Islam after the Qur’an and the words of his companions along with their religious practices are evaluated. In the first section of the thesis, Fatwa and Its Conceptual Framework, in the second section, Fatwa in History and Today, and in the third section Hadiths Related to Issuing a Fatwa Benightedly are examined.
