Tahrîcü’l- Fürû Ale’l-Usûl Literatüründe İsnevî’nin Yeri -Et-Temhîd Fi Tahrîci’l- Fürû Ale’l-Usûl Eseri Özelinde-

Abstract

İlimler tarihinde herhangi bir ilim teşekkül edip temel metinleri ortaya konulduktan sonra o ilmin öğrenimini veya öğretimini kolaylaştıracak alt disiplinler ortaya çıkmaya başlar. Tahrîcü’l-fürû ale’l-usûl literatürü de böyle bir ihtiyaca binaen fıkıh ilminin alt disiplini olarak ortaya çıkmıştır. Şâfiî mezhebine müntesip âlimlerin ilk temsilciliğini üstlendiği tahrîcü’l-furu ale’l-usûl literatürü Zencânî’nin eseriyle sistematik bir yapı kazanmıştır. Literatür içerisinde telif açısından üçüncü eser olarak nitelendirebileceğimiz İsnevî’nin et-Temhîd fî tahrîci’l-fürû ale’l-usûl adlı eseri de bunlardan bir tanesidir. Bu eser usul kaideleri sistematiğine göre oluşturulması, kaideleri ve meseleleri işleyiş tarzı, konuların anlaşılır olması ve sadece Şâfiî mezhebi içerisindeki ihtilafları konu alması bakımından öne çıkmaktadır. Bu çalışmamızda İsnevî’nin et-Temhîd adlı eseri tahrîcü’l-fürû ale’l-usûl literatürü içerisindeki yeri ve öne çıkan özellikleri açısından incelenmiştir.

In the history of sciences, after any science is formed and its basic texts are revealed, sub-disciplines that will facilitate the learning or teaching of that science begin to emerge. Tahrîcü'l-furû ale'l-usûl literature has emerged as a sub-discipline of the science of fiqh due to such a need. Tahrîcü'l-furu ale'l-usûl literature, which was first represented by the scholars of the Shafi'i sect, gained a systematic structure with the work of Zencânî. Isnevi’s work titled "et-Temhîd fî tahrîci’l-fürû ‘ale’l-usûl", which we can describe as the third work in the literature, is one of them. This work stands out in terms of its formation according to the systematic of the rules of procedure, the way the rules and issues are handled, the clarity of the subjects, and for addressing only the conflicts within the Shafi'i sect. In this study, Isnavî’s work named et-Tamhîd has been examined in terms of its place and prominent features in the tahrîcü'l-furu ale’l-usûl literature.
