Futbolda Opsiyon Hakkı

Abstract

Bu çalışmada öncelikle taraflara özgür iradeleri ile belirledikleri, sözleşme süresinin bitiminden önce bildirimde bulunma koşulu ile belirli bir süre sözleşmeyi uzatma imkânı tanıyan profesyonel futbolcu sözleşmelerindeki opsiyon hakkının tanımı ve hukuki niteliği üzerinde durulacaktır. Ardından opsiyon hakkının geçerliliğine ilişkin kriterler CAS ve Tahkim Kurulu kararları ışığında açıklanacaktır.

In this study, the definition and the legal nature of the option clauses in the professional football contracts, which allows the parties to extend the duration of the contract provided that one party notifies the other party prior to the expiry date of the contract and which the parties regulate freely will be focused on. Subsequently, the criteria on whether an option clause is valid or not will be explained under the light of the decisions of CAS and TFF Arbitration Board.
