Yerli toplumlarda 'biz ve öteki' kavramlarının oluşum süreci ve hukuki sonuçları

Abstract

Bu çalışmada yerli toplumlarda "Biz" kimliğinin oluşumunda "Öteki" kavramının etkisi incelenmekte ve "Ötekine Karşı Biz" olarak adlandırılabilecek özgün bir kimlik algısının evlilik ve toplumsal örgütlenme ekseninde nasıl şekillendiği üzerine odaklanılmaktadır. Bu özgün kimlik algısının modern Türk hukukunda var olan normlara nasıl etki ettiği somut örneklerle açıklanmaktadır. İşlem ve yöntemler arasında, literatür taraması ve nitel araştırma teknikleri bulunmaktadır. Elde edilen sonuçlar, yerli toplumlarda evlilik ve aile yapısının, toplumsal örgütlenmenin ve dayanışmanın "Ötekine Karşı Biz" kimliğini nasıl şekillendirdiğini göstermektedir. Bu kimlik algısının, toplulukların diğer gruplarla olan ilişkilerini belirlediği ve çeşitli mücadelelerin veya iş birliklerinin temelini oluşturduğu ve modern Türk hukukunda var olan normlara etki ettiği sonucuna varılmıştır.

In this study, the impact of the concept of the "Other" on the formation of the "We" identity in indigenous communities is examined, focusing on how a unique perception of identity, which can actually be termed as "We Against the Other," is shaped around the axes of marriage and social organization. This unique perception of identity is explained with concrete examples of how it affects the existing norms in modern Turkish law. The procedures and methods include a literature review and qualitative research techniques. The results obtained show how marriage and family structures, social organization, and solidarity in indigenous communities shape the 'Us versus Them' identity. It has been concluded that this perception of identity determines the communities' relationships with other groups and forms the basis for various struggles or collaborations, as well as its impact on the existing norms in modern Turkish law.
