القواعد الفقهية و الأصوﻟﻴة لكتاب الصوم ﻓﻲ كتاب الاختيار

Abstract

لما كتاب للفقه الإسلامي مكانته السامية هند هذه الأمة لما فيه من ربط الأحكام بأفعال المكلف الذي نزل هذا التشريع لأجله، فكانت تلك الأحكام الفقهية قد شرعت لذلك، و كانت تلك الفروع الفقهية مرتبطة بأصولها و قواعدها الأصولية و الفقهية اخترت بحثي هذا و هو )) القواعد الأصولية و الفقهية لكتاب الصوم في كتاب الإختيار)) و قد بنيت بحثي هذا على تمهيد و فصلين و خاتمة. و ذكرت في التمهيد معاني عنوان الرسالة، فبينت معنى القاعدة و الضابط.

Islâm fıkhı; seriatın getirdigi hükümleri mükelle erin ameline bagladıgından dolayı bu ümmet nezdinde son derece önemli oldugu için, fıkhî hükümler seriatta bundan dolayı konuldugu için ve furû’ fıkıh dedigimiz alt konular da usûl kâidelerine baglı oldugu için ben de bu arastırmamda “El-Ihtiyâr’ Kitabının ‘Oruç’ Bölümündeki Usûl ve Fıkıh Kâideleri” konusunu ele aldım.

Since Islamic jurisprudence has a lo y position in this nation because of its linking of rulings to the actions of the person responsible for whom this legislation was revealed, so those jurisprudential rulings were legislated for that, and those branches of jurisprudence were related to its fundamental and jurisprudential foundations and rules, so I set out on this search and that is ( e Fundamental and Jurisprudential Rules of the Book of Fasting in the Book of Al-ekhtiyar), is research is based on a preface, two chapters, and a conclusion. And I mentioned in the preface the meanings of the message title so I explained the meaning of the rule (Al-qaeda) and the base (Aldabet), en the meaning of the jurisprudential rule and the jurisprudence base with mentioning some di erences between them.
