Mirastan feragat sözleşmesi

Abstract

1926 yılında Türk Kanunu Medenisi' nin kabulü ile Türk Hukuku mirastan feragat kurumu ile tanışmıştır. Mirastan feragat sözleşmesi Borçlar Hukuku ve Miras Hukukunun iç içe geçtiği özel bir hukuki yapıdır. 4721 Sayılı Türk Medeni Kanunu'nda mirastan feragat sözleşmesi, mirasbırakan ile muhtemel mirasçısı arasında, mirasçının gelecekteki muhtemel miras hakkından vazgeçtiği bir sözleşmedir. Taraflarca mirasbırakanın sağlığında akdedilen bu sözleşme, mirasbırakanın ölümü ile hüküm ve sonuçlarını doğurur ve feragat eden mirasçı sıfatını kazanmaz. Geçmişte ve günümüzde bazı hukuk sistemleri, gelecekteki miras hakkı üzerinde tasarrufu konu edinmesi nedeniyle mirastan feragati reddetmiş, bazı hukuk sistemleri ise kabul etmiştir. Sözleşme ile mirasbırakan, feragat eden kişinin mirasçılığını da engellediğinden aynı zamanda olumsuz miras sözleşmesi olarak da adlandırılmaktadır. Sözleşme taraflarından kimin önce öleceği, sözleşme yapıldığı anda belli olmadığından muhtemel mirasçı terimi kullanılmaktadır. Miras paylaşımının önceden belirlenmesi ve muhtemel anlaşmazlıkların önüne geçmek maksadıyla yapılan mirastan feragat sözleşmesi ile feragat eden muhtemel mirasçı kısmen ya da tamamen miras payından vazgeçebilir. Ölüme bağlı tasarruf olması nedeniyle, miras sözleşmesi şeklinde düzenlenebilir. Bu tez çalışması, mirastan feragat sözleşmesinin hukuki niteliğini, şartlarını, tarafları bakımından meydana getirdiği sonuçları, sözleşmenin hükümsüzlük ve sona erme ihtimallerini inceler. Ayrıca bu çalışma kapsamında uygulamaya yönelik sorunlar ele alınmış, Alman ve İsviçre Hukukundaki düzenlemelerle karşılaştırılarak Türk Hukuku ile aralarındaki benzerlik ve farklar ortaya koyulmuştur.

The Turkish legal system acquainted itself with the institution of renunciation of inheritance upon the adoption of the Turkish Civil Code in 1926. The renunciation of inheritance contract constitutes a distinct legal construct wherein the realms of Contract Law and Inheritance Law intertwine. Regulated under the Turkish Civil Code No. 4721, the renunciation of inheritance contract agreement is a contract between the testator and prospective heir, whereby the heir waives their future potencial inheritance rights. This contract, concluded during the life time of the testator, takes effect upon the testator's death, and the renouncing party does not aquire the status of an heir. Historically and in contemporary times, some legal systems have rejected the renunciation of inheritance due to its nature, involving the dispotion of future inheritance rights, while others have accepted it. Since the agreement prevents the renouncing party from becoming an heir, its also referred to as a "negative inharitance agreement". Through the renunciation of inharitance agreement, which aims to pre-arranging the distribution of the estate and prevnting prospective disputes, the prospective heir may partially or fully waive their inheritance rights. As the agreement constitutes a testamentary dispotion, it must be formalized in the form of an inheritance contract. This thesis examine the legal nature of the renunciation of inheritance agreement, its conditions, the effects it has on the parties involved, and the possibilities of invalidity and termination of the contract. Additionally, practical issues regarding its application are addressed, comparing the regulations under Turkis Law with those in German and Swiss Law, highligting similarities and differences.
