Abstract

إلى روح مَن أ دبني ور ا بّني، ومِن كل أصناف إلعطف أولاني، وفي موإطن إلضعف ق وإني، مَن قلبي له وإمِق، ونهجه لي سائق، وفضله علي سابق لاحق، أُهدي هذإ إلعمل إلمتوإضع، إلذي هو بركة دعوةٍ لطالما كان يدعو بها في خلوإته وجلوإته قائلاً: إللهم إجعل ولدي خادماً لس نة حبيبك صلى الله عليه وس ا لّ. فأ سأ ل الله أن تكون تلك إلدعوة قد أصابتني، و إني على إلعهد أسير، فاللهم أعِن وتمام ويَ ا سّ كل عسير، وإجعل هذإ إلعمل في ميزإن حس نات وإلدي إلكريم، و أنِر قبره وإجعله روضة مِن رياض جنة إلنعيم، وإلحمد لله رب إلعالمين.İmam Malik b. Enes meşhur, kadîm fıkıh ve hadis alimlerinden biridir. Medine’de dünyaya gelmiş ve hayatının tamamını Medine’de geçirmiş, tabiînden pek çok alimden ders alması sebebiyle zamanındaki farklı bir şahsiyettir. İmam Malik ismi genellikle şaheseri Muvatta ile birlikte anılmıştır. Muvatta adlı eser, ilim dünyasında takdirle karşılanmış, çok değerli bir hadis kaynağıdır. Ancak İmam Malik’in Muvatta dışında da pek çok rivayetleri bulunmaktadır. İmam Malik’in Muvatta adlı eserinin şerhleri, bu eserdeki fıkhî ictihad ve istinbatlar ve Muvatta’ın farklı rivayetleri konusunda onlarca eser telif edilmişken, Muvatta dışındaki rivayetlerinin derlenmesi, değerlendirilmesi ve bu rivayetlerin Muvatta’a alınmama sebepleri ilmî araştırmaya değer önemli konulardan biri olduğu halde üzerinde pek fazla durulmamıştır. Ancak İmam Malik’in Kütüb-i Sitte’den rivayet edilen, ama Muvatta’ın bize ulaşan hiçbir nüshasında bulunmayan rivayetleri hakkında Ebu’l-Kâsım el-Cevherî (ö.381/960), Dârekutnî (ö.385/964), İbn Abdilberr (ö.463/1042), Ebu’l-Velid Bâcî (ö.474/1082) gibi ilim erbabının önemli değerlendirmeleri bulunmaktadır, İmam Malik’in bazı rivayetlerinin Muvatta'da yer almaması, senedindeki bazı ravilerin tenkid edilmeleri veya meçhul olmaları gibi sebeplerden kaynaklandığı gibi; Muvatta’a alınmayan hadisle amel edilmemesi, hadisin mensûh olması, hadisin ehl-i Medine’nin ameline muhalif olması veya başka tercih sebeplerinden kaynaklandığı görülmektedir. İmam Malik’in Muvatta dışındaki rivayetlerinin özel olarak birer birer incelenmesi, ilim dünyası için anlamlı bir çalışma olacak, daha önce bu denli ayrıntılı bir şekilde araştırılmamış olan bu konunun ele alınması, İmam Malik'in hadis tenkidindeki müstesna yeri ve fıkhî derinliğine ışık tutacaktır.Imam Malik b. Enes is one of the famous ancient scholars of fiqh and hadith. He was born in Madinah and spent his entire life in Madinah. Naturally, he was a different person in his time because he took lessons from many scholars. The name of Imam Malik is often associated with his masterpiece al-Muvatta. The work named al-Muvatta is a very valuable source of hadiths that has been appreciated in the world of science. However, he has many narrations besides al- Muvatta. Its explanations and its contents are abundant as are the scholars who dealt with its interpretation. There is no speculation on that, as "Al-Muwatta" is the summary of Malik's knowledge. Certainly all their efforts are blessed and valued, however, there are researches outside of al-Muwatta that have not been given the opportunity to be completely investigated. Taking them into consideration might help us to fully understand the "al- Muwatta" as well as its author. In this case, a full comprehension would be accomplished through the compilation of the different hadiths narrated by Malik, but that still were not included in his book, as well as by looking for the reasons that led him not to include them. It is a subject whose relevance drew the attention of several scholars. Some of them, such as Abu al-Qasim al-Jawhari, al-Daraqutni, al-Baji and, and Ibn Abd al-Barr, but God decreed that nothing of the aforementioned knowledge should reach us. Therefore, the present thesis has collected the narrations of Imam Malik, may God have mercy on him, found within the six books that were not selected for inclusion into the "al-Muwatta". Additionally, it covers different explanations on why these narrations were not included, pointing out some relevant commentaries that have been written on the book in a way that makes it easier for the reader to understand the Maliki school and its approach, both jurisprudential and narrative. The value of this thesis is nothing more than a drop of water in an ocean of many other researches that great scholars have previously carried out, and I ask God the Most High to accept it in the hope that it will benefit many.
