Although equality has long been equated with justice, it has never been a concept with a single meaning and function. By permitting differential treatment, provided that it is reasonable and consistent in both the public and private spheres, it gradually became detached from justice and subsequently became, as it were, a basis for inequalities. Liberal constitutionalism's presupposition that desert (entitlement) is determined by the free market has reinforced inequality and hierarchy, particularly through relationships established in the private law sphere, and has subsequently led to the erosion of the concept of equal citizenship. Since self-respect and autonomy are partly dependent on equality of conditions, equality should be related to the distribution of benefits and services. A social order that does not ensure a minimum standard of living should be condemned not only because it denies the equality of citizens but also because it is unjust. The true meaning of justice, which is to give people their due, must not be overlooked; equality must likewise be interpreted as equality in the satisfaction of basic needs. If the liberal constitutional state seeks to function as a social state, it must reconcile the principles of entitlement and need. It should be emphasised that a constitutional order that is unjust and not worth living under when, in light of the reality that citizens whose basic needs are not met move further away from equality in proportion to the restriction of their freedoms, it fails to meet this requirement.
